However, we will not otherwise alter the information content of the listing without the agreement of the owner.

We do not accept listings or events for websites containing pornography, violence, gambling, racism or otherwise illegal content, promotion of guns, or promotion of illegal activities. We will check all websites listed when they are submitted, but we cannot guarantee that they will remain free of such content, or accept liability if such content is found.
It is members' own responsibility to ensure they have obtained permission in connection with any copyrights and trademarks for text and images used in their listings, and Beach Web Design cannot be held responsible for ensuring this. However, if we are informed of content in breach of our guidelines, or if we discover such content later on, the listing and / or event will be removed and no refund will be offered. We will also remove listings if we receive justifiable complaints of targeted personal attacks (ie bullying).

Force Majeure
Neither Beach Web Design nor the website members shall be liable for any delay or failure to perform any of their obligations if the delay or failure results from events or circumstances outside their reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, the act or omission of government, highway authorities or any telecommunications carrier, operator or administration or other competent authority, the act or omission of any Internet Service Provider, or the delay or failure in manufacture, production, or supply by third parties of equipment or services, and the party shall be entitled to a reasonable extension of its obligations after notifying the other party of the nature and extent of such events.
Assignment
Beach Web Design may assign or otherwise transfer this agreement at any time. If this action is taken, Beach Web Design will inform the customer in writing at least one calendar month in advance. If directory members wish to transfer their paid listing features or subscription billing agreements to somebody else they must obtain written consent from Beach Web Design, either by using the contact form on this website or by writing to: Beach Web Design, PO Box 178, Exmouth, Devon, EX8 1WT. Please specify your membership and listing details when writing to us.
Severance
If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this Agreement had been agreed with the invalid illegal or unenforceable provision eliminated.
Indemnity
Directory members agree to indemnify and hold Beach Web Design and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Beach Web Design arising out of any breach by the directory member of the terms of this Agreement or other liabilities arising out of or relating to the Website.
